If the child is over 5 and is nude, I don't believe it can be art. Not that it is necessarily porn. I don't consider a picture of 2 six year olds in the bath tub to be art, but it is also far from porn. It's just a family photo. Now to take that photo and sell it as art..... I wouldn't consider it such. In Europe and other cultures, I believe the line is a little lower. Children as old as 8 or 9 run around public pools and such naked as the day they were born. In their society, I think that nude photos of such children could be considered art. The true deciding factor is the true intent of the photos. Sadly, many photos that could be considered art, are taken solely for the purpose of creating a lawful way to produce material that is intended for arousal. Coming back to America and today's society, I just don't see how a child over the age of 5 could stand naked, in front of a camera, for the purpose of posing, and not feel strange about it. I'm not saying that that is a bad thing either. It is just how our culture is. I figure, why even risk it. It's not like we will suffer as a society if we do not have pictures of naked children in our art. I think the people that make a big deal out of it, have a hidden agenda. However, I will defend against these rabid moral authoritarians who want to imprison parents for taking a pic of their kid running naked through the back yard. |
