Denying a person liberty, including liberty to travel to any country that will let them in, without due process has constitutional problems. And if the adults have Swiss(?) citizenship, denying them the freedom to travel to "their own country" would be a real international incident. Now, if the parents were under indictment, then they could be ordered to not leave the county, state, or country to avoid flight risk. Now, it probably WOULD be legal to warn the parents that if they both stayed away for the duration without assigning guardianship to a relative to look after the boy, they would face "child abandonment" charges when they returned AND parental rights would be at risk, EVEN if the child were found the juvenile equivilant of not guilty. -David ("d") |
