I don't know what the prevalence of that kind of sanity is, but I don't think it's every where. I once heard about an 18yo and his 17yo girlfriend, or maybe she was 16. They had sex, I think they later even married. But the law found out about them having sex, and he was up for rape. The jury was in tears, realising there was no crime here, but facing the stark legality and felt obliged to say he was guilty. Apparently juries don't need to enforce the law in this way if they think it's ridiculous, but for whatever reason, they weren't aware of this. I can't vouch for the veracity of this story, but it's a good one. Fod |
